Welcome to SongUnboxed. By accessing or using our website at songunboxed.com or purchasing any of our services, you agree to be bound by these Terms of Service. Please read them carefully.

1. The Service

SongUnboxed provides personalized custom song creation services. Customers complete a personalization quiz providing information about the song recipient, which our team uses — along with AI-assisted tools — to create original custom songs delivered digitally.

2. Orders and Payment

• All orders are processed through Shopify's secure checkout. By placing an order, you confirm you are authorized to use the payment method provided.
• Prices are listed in USD. We reserve the right to change prices at any time; changes do not affect orders already placed.
• Delivery speed options (Standard 48h / Express 24h) refer to business processing time after order receipt, not delivery of physical goods.

3. Delivery

Your custom song will be delivered to the email address you provide at checkout. Delivery timelines are estimates and may vary based on order volume. SongUnboxed is not responsible for delays caused by incorrect email addresses or spam filters.

Songs are delivered as digital audio files (MP3) via a private download link. We recommend saving your song upon receipt.

4. Revisions

All orders include up to 2 free revisions (lyrics and/or melody). Revision requests must be submitted within 30 days of song delivery. Revisions are processed within standard delivery timelines. Revision requests submitted after 30 days may incur additional fees.

5. Intellectual Property

Upon full payment, SongUnboxed grants you a non-exclusive, non-transferable personal license to use, share, and enjoy your custom song for personal, non-commercial purposes.

You may not resell, redistribute, publicly perform for commercial gain, or claim authorship of the song. SongUnboxed retains the right to use anonymized song samples for marketing purposes unless you request otherwise in writing.

6. User Content

By submitting personal stories, memories, names, and other content through our quiz, you grant SongUnboxed a limited license to use that content solely for the purpose of creating your custom song. You represent that you have the right to share this content and that it does not violate any third-party rights.

7. Prohibited Use

You agree not to:

• Use our service to create content that is hateful, defamatory, obscene, or illegal
• Attempt to reverse-engineer, copy, or resell our song creation process
• Submit false or misleading information
• Use automated tools to access our website without authorization

8. Disclaimer of Warranties

SongUnboxed provides its services "as is" without warranties of any kind, express or implied. We do not guarantee that songs will meet every specific expectation, as custom creative work is inherently subjective. Our revision policy is designed to ensure your satisfaction.

9. Limitation of Liability

To the maximum extent permitted by law, SongUnboxed and AugmentusVentures LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for your order.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
